These Terms of Service ("Terms") govern your access to and use of OutfitterAI services, including the intelligence platform, play library, coaching services, and any related tools (collectively, the "Service"), operated by OutfitterAI ("we," "us," or "our").
By creating an account, enrolling in the pilot program, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
OutfitterAI provides business intelligence analysis for field service businesses in the trades. The Service ingests business data you provide, analyzes it against a network benchmark dataset, and delivers monthly briefings, play recommendations, and coaching support. The Service is designed for business use by owner-operators and their authorized team members.
You must be at least 18 years old and authorized to enter into binding agreements on behalf of the business you represent. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
OutfitterAI may offer a free pilot period ("Pilot") to qualifying businesses. During the Pilot:
Paid plans are billed monthly, charged when you enroll. Pricing is as displayed on our pricing page at the time of enrollment. You may cancel at any time; cancellation takes effect at the end of the current billing period. OutfitterAI does not offer refunds for partial billing periods except where required by applicable law.
30-day money-back guarantee. New paid subscriptions are backed by a 30-day money-back guarantee. If you request a refund within 30 days of your first paid subscription charge, we will refund that first month's subscription fee. The guarantee applies once, to your initial subscription charge only; it does not apply to subsequent monthly renewals or to usage-based token top-ups. To request a refund under this guarantee, contact us at support@getoutfitter.ai within the 30-day window.
For website products, your subscription begins when your design/mockup is delivered to you, regardless of whether your site has been made live at your desired domain or URL. Making a site live can depend on things outside OutfitterAI's control — for example, access to your domain registrar or DNS settings, hosting or third-party account credentials, your review and approval of the design, or simply your availability to respond. If your site cannot be made live because of a delay, missing access or approvals, non-responsiveness, or any other circumstance not caused by OutfitterAI, your subscription will continue to be billed on schedule, and no refund, credit, or billing pause will be issued for that period. We will make reasonable efforts to help resolve any access or technical issues preventing go-live. If you believe your situation involves unique or extenuating circumstances, contact us and we will review it through our standard customer support process; any billing adjustment remains at OutfitterAI's sole discretion.
Where a Growth Partnership proposal, presentation or order describes a zone as "exclusive," exclusivity means only this: while your Growth Partnership account is active, paid up, and your monthly spend meets the level set for that zone, OutfitterAI will not enroll another company in the same trade as a Growth Partnership account for that zone. Zone exclusivity:
(a) applies only to other Growth Partnership accounts. It does not apply to self-service ("retail") users of the Service, such as companies that sign up on their own for a website, Emma, Front Desk, postcards or self-serve advertising, who may operate in, and market to, the same zone;
(b) is not permanent. OutfitterAI may change, resize or end zone exclusivity, including the zone's boundaries and the spend required to keep it, on thirty (30) days' written notice. A change does not affect amounts you have already paid;
(c) ends automatically if your spend falls below the zone's level for a full billing month, your account is paused or past due, or your Growth Partnership ends; and
(d) does not limit advertising platforms, mail carriers or any other third party, and is not a promise that no competitor will market in the zone or that any result will be achieved.
Token wallet. Many parts of the Service are paid for with prepaid tokens held in your account's token wallet. One token equals one U.S. cent ($0.01). The number of tokens each service uses is shown on our pricing page and in your workspace at the time of use. Usage draws down your balance, which never goes below zero. When your balance reaches zero, services paid with tokens pause until tokens are added, unless auto-refill adds them.
Website Professional. Website Professional is paid in tokens, monthly. The first month is charged from your balance when you turn it on, and each following month on its renewal date. If your balance is short at renewal, we will try auto-refill first. If the month still cannot be paid, Website Professional continues for a grace period of seven (7) days; if it is still unpaid after that, Website Professional ends and the "Built by Outfitter" badge returns to your site. Your website stays live. You may turn Website Professional off at any time; it then runs to the end of the month already paid, and partial months are not refunded.
Auto-refill authorization. When you add a payment card and leave auto-refill on, you authorize OutfitterAI to charge that card, or the primary card on your account, the refill amount shown to you each time your token balance falls below the refill point shown to you, until you turn auto-refill off. The refill amount and refill point are shown when you add the card, and you can change them or turn auto-refill off at any time on your billing page; changes apply to refills after you make them. We notify you by email or text when a refill is charged or declined.
Unused tokens. Prepaid tokens do not expire while your account is open. Tokens have no cash value and are non-refundable, except where required by applicable law.
You retain all ownership of the business data you provide to OutfitterAI. By submitting data, you grant OutfitterAI a limited license to process, analyze, and store that data for the purpose of delivering the Service. Data handling is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You agree not to:
Plays, briefings, and other outputs generated by the Service are provided for your business use. OutfitterAI grants you a non-exclusive, non-transferable license to use these outputs internally. You may not distribute, sell, or sublicense Service outputs to third parties.
Plays and recommendations are provided for informational and strategic purposes. They do not constitute legal, financial, accounting, or professional advice. Results will vary by business and are not guaranteed.
The OutfitterAI platform, play library, benchmark methodology, and all related software and content are owned by OutfitterAI and protected by applicable intellectual property laws. These Terms do not transfer any IP rights to you beyond the limited license described above.
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Service, and to use such information only as necessary to perform under these Terms.
If you provide a phone number to OutfitterAI (via a recorded sales conversation, a web form, or any other supported channel), you authorize OutfitterAI to send you SMS messages from our business number(s) regarding your inquiry, demo, or account. Specifically:

The Service is provided "as is" and "as available." OutfitterAI makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any analysis, recommendation, or output. Business outcomes depend on many factors outside our control.
To the maximum extent permitted by law, OutfitterAI's total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to OutfitterAI in the three months preceding the claim. OutfitterAI shall not be liable for any indirect, incidental, consequential, or punitive damages.
Either party may terminate these Terms at any time. You may terminate by canceling your account. We may terminate or suspend your access if you violate these Terms or if we discontinue the Service. Upon termination, your license to use the Service ends immediately.
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hennepin County, Minnesota.
We may update these Terms from time to time. We will notify you of material changes by email or via the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
